Under Personal Data Protection Act 2010

This personal data protection Notice is issued by CPI Land Sdn. Bhd. (Registration No. 1090546-D) and/or any of its subsidiary companies (collectively, “CPI”, “we“, “us” or “our“) pursuant to the Personal Data Protection Act 2010 (“Privacy Notice”). The Privacy Notice explains the type of data we collect or have collected and how we collect and handle the data, the purposes of processing such data, the parties we disclose or have disclosed the data to and the choices available to you including how to access and correct such personal data held by CPI.

 

Personal Data which we collect from you

During your dealings with CPI, we may collect a variety of your personal data and process your information, which may include the following (“Personal Data”):-

Name, national registration identification card number, passport number, photograph, e- mail address, postal address, age, telephone number, mobile number, EPF details, SOCSO details, income tax details, employment details and history including details of present and past income, bank account details, credit card details, marital status, gender, nationality, children’s details, names of relatives and how related including personal and contact details of relative, personal interests, hobbies, skills, languages, education or other related qualifications, achievements, ethnic origin, details of referees, medical records, physical, mental health or condition, political opinions, religious beliefs or other beliefs of similar nature, commission or alleged commission of offence, sexual orientation, directorship in companies, shareholding in companies, assets, involvement in legal proceedings including details of such legal proceedings, details of loans and other financial transactions, solvency, financial status, ownership of property, car registration details and all other related information necessary and incidental to our business.

The list of Personal Data stated above is not exhaustive and may include other personal data depending on the nature of dealings or transaction.

 

How we collect Personal Data

We collect Personal Data through several methods which include but not limited to:-

  • information, messages or comments you have provided to us via the CPI’s website or by whatsoever means and/or in whatsoever manner;
  • information obtained independently by us or given to us from other lawful sources and the contents of all forms and/or documents submitted and/or collected by CPI;
  • official registration forms (either electronic or printed) for new launches or property roadshows, showcases, exhibitions or any other promotional events;
  • letter of offer from any financial institutions (local and foreign) for pre-approved loans;
  • information collected when you register or update an online profile or when you fill in or update your information with us;
  • the contents of all printed and electronic forms or documents submitted to us via printed collateral or forms, CPI’s website and any digital and mobile platforms (eg. email, Facebook, Twitter, Instagram, Whatsapp, Viber and any social media and apps);
  • information input or submitted to online facilities such as search tools and calculators, personalization preferences you select as you use CPI’s website, digital and mobile platforms;
  • information submitted if you participate in survey or competition whether via online or otherwise;
  • information may also be collected from cookies through the use of CPI’s website;
  • information directly from you or indirectly from your employer or credit reference agencies when tendering for projects, when you send us completed enquiry and/or credit application forms via various means, including online and physical hardcopies;
  • any referrals from a person which have included their verifiable personal contact details; and
  • business cards that were dropped or given to our employees, agents, brokers or associates.

 

Purposes of Collection of Personal Data

We collect, retain, use and process your Personal Data for purposes which may include:

(a)   providing you with services or benefits under CPI’s businesses or policies and other similar capacity;

(b)   for and/or in connection with the processing of the necessary transaction in relation to the relevant matter;

(c)    for and/or in connection with complying with laws and regulations including requirements of any government or quasi-government or regulatory authorities or court of law. Where required by law, where CPI considers that such use or disclosure is necessary to respond to any claims or legal process, or where CPI suspects that fraud or unlawful activity has been, is being or may be engaged in;

(d)   for and/or in connection with all other purposes necessary and/or incidental to our business and all purposes necessary for or related to any of the above purposes;

(e)   for and/or in connection with internal purposes such as auditing, data analysis, and research to improve CPI’s products, services and customer communication.

(f)    to keep you notified of CPI’s latest product announcements or upcoming events. Kindly notify us in writing if you do not wish to be on our mailing list;

(g)   to send you important notices, emails, letters or sms, like communications about in relation to the purchases and changes to CPI’s terms, conditions, and policies. As such information is crucial to your custom with CPI, you are advised not to opt out of receiving such communications;

(h)   processing your application submitted to CPI;

(i)    for and/or in connection with the operation, administration, development, record-keeping or enhancement of CPI’s businesses including for the purpose of which is relevant to support and/or assist in any of CPI’s businesses or CPI’s website;

(j)    for and/or in connection with the administration, management and/or enforcement of the commercial transaction and for contact and communication with you;

(k)   for and/or in connection with the enforcement of CPI’s rights pursuant to any letter, agreement and/or document including seeking legal and financial advice, taking any preliminary steps or commencing any legal actions; and/or

(l)    for any other purposes that is incidental or ancillary or in furtherance to CPI’s purposes.

 

Disclosure of Personal Data

When processing your Personal Data, you further agree that we may disclose and transfer (whether in Malaysia or abroad) such Personal Data to the following persons including but without limitated to:

(a)      any company within CPI and departments within CPI including any of our employees on a need-to-know basis;

(b)     our auditors, lawyers, consultants, insurers, proposed insurers, advisers, bankers, agents, third party service providers (including law firms in other jurisdictions), business partners or associates or legal referral guides who are under a duty of confidentiality to us;

(c)      government or quasi-government and regulatory authorities in Malaysia and in countries where we, our auditors, lawyers, advisers, bankers, agents, third party service providers (including law firms in other jurisdictions), business partners or associates or legal referral guides have a presence or require approvals or are required to submit such information;

(d)     all other persons or bodies who provide us with services necessary and/or incidental to our businesses;

(e)     third party providers who provide services such as information processing, extending credit, fulfilling customer orders, delivering products to you, managing and enhancing customer data, providing customer service, assessing your interest in CPI’s products and services and conducting customer research or satisfaction surveys; and

(f)      if necessary, our contractors, suppliers, joint venture partners, advertisers, network operators and associated companies.

We may process your Personal Data including contacting you for the purpose(s) stated herein via telephone calls, text messaging, emails, cross-platform mobile messaging applications, post, facsimile, social media, whatsapp or by whatsoever form of available modes of communication.

 

Transfer of Personal Data

We may transfer your Personal Data to places outside Malaysia that have a different data protection regime when carrying out any of the purposes stated herein.

 

Right of Access and Correction to Personal Data

Pursuant to the Personal Data Protection Act 2010, you have the right of access to your Personal Data held by CPI upon payment of a prescribed fee and you may request CPI to correct any of your Personal Data that is inaccurate, misleading, incomplete or out-of-date, subject to any applicable legal restrictions and contractual conditions, unless compliance is refused under the Personal Data Protection Act 2010. We will notify you of the reasons for not being able to accede to your request. We may also exercise our discretion in allowing the corrections requested and/or may require further documentary evidence of the new data to avoid fraud and inaccuracy.

You may also withdraw your consent, in full or in part, or restrict the purposes and methods in which we process your Personal Data and the personal data relating to other persons who may be identified from your Personal Data.

Please take note that notwithstanding the withdrawal of your consent, we may still process your Personal Data under circumstances permitted by law.

 

Update or Changes to Privacy Notice

We review, modify, amend and update this Privacy Notice from time to time without prior notice to reflect the changes in law and business practices. We would advise you to obtain the latest version of our Privacy Notice by contacting us or visiting our website on a regular basis to ensure that you are familiar with the latest version. By continuing to instruct us/use our services/omitting to withdraw your consent, you are deemed to have accepted and consented to our latest revision and update contained therein.

 

Personal Data of third parties

You hereby confirm that you have obtained the consent from the person(s) whose personal data may be given to us by you or identified from your Personal Data which may be processed and disclosed by us for the purposes stated herein including disclosure to the parties stated herein.

You are responsible to provide accurate, complete and updated Personal Data about yourself and/or any other person whose personal Data you provide to us. As such, as and when such Personal Data becomes inaccurate, incomplete or outdated, you should correct or update such Personal Data by contacting us or submitting the latest Personal Data to us in writing in accordance with the manners above.

CPI’s website may contain links to other sites and pages. By activating a link, such as for example by clicking on a banner of an advertiser, you leave CPI’s website and CPI does not exercise control over any Personal Data or any other information you give to any other entity after you have left CPI’s website.

 

Cookies

When you view CPI’s website, CPI may store some data on your compute in the form of a “cookie” to automatically recognize your personal computer the next time you visit.
